THE EDUCATION ACT 1944

Part I sets out provisions relating to the Central Administration (s. 1 – s. 5).  Part II provides details on The Statutory System of Education (s. 6 – 69).  Part II imposes duties relating to education.  The Act includes a duty of local education authorities to secure provisions of primary and secondary schools (s. 8), a duty of local education authorities to ascertain what children require special educational treatment (s. 34), duty of parents to secure the education of their children (s. 36), duty of parents to secure regular attendance of registered pupils (s. 39), general duties of local education authorities with respect to further education (s. 41) and a duty to attend county colleges in accordance with college attendance notices (s. 44).

Sections 48 – 57 set out supplementary provisions as to primary, secondary and further education.  Provisions include medical inspection and the treatment of pupils (s. 48), provision of milk and meals (s. 49), provision of board and lodging otherwise than at boarding schools or colleges (s. 50), provision of clothing at schools maintained by local education authorities (s. 51), provision of facilities for recreation and social and physical training (s. 53), power to ensure cleanliness (s. 54), provision of transport and other facilities (s. 55), power to provide primary and secondary education otherwise than at school (s. 56) and a duty of local education authorities to report to local authorities under 3 and 4 Geo. 5 in certain cases (s. 57).

Sections 58 – 60 set out provisions regarding the employment of children and young persons.  Section 58 provides the adoption of enactments relating to the employment of children or young persons.  Section 59 empowers the local education authorities to prohibit or restrict employment of children.  Section 60 addresses the effect of college attendance notices on computation of working hours.

Part III sets out provisions that apply to independent schools (s. 70 – s. 75).

Part IV is a general section.  Section 76 provides that pupils are to be educated in accordance with the wishes of their parents.
