Criminal Justice Act 1991

Part I empowers the courts to deal with offenders (s.1 – s.31).  Part II gives details on the early release of prisoners (s.32 – s.51).

Part III applies specifically to children and young persons (s.52 – s.72).  The Act provides details as to the competence of children as witnesses (s.52), notices of transfer in certain cases involving children (s.53), video recordings of testimony from child witnesses (s.54) and states further amendments of enactments relating to children’s evidence (s.55).

The Act sets out the responsibilities of parent or guardian (s.56 – s.58).  This includes attendance at court of parent or guardian (s.56), the responsibility of parent or guardian for financial penalties (s.57) and binding over of parent or guardian (s.58).

Details of detention is provided for at a police station (s.59), remands and committals to local authority accommodation (s.60), provision by local authorities of secure accommodation (s.61) and transitory provisions pending provision of secure accommodation (s.62).

Further details relating to young offenders are provided for.  This includes custodial sentences under the 1982 Act (s.63) and under the 1933 Act (s.64), details on the supervision of young offenders after release (s.65), supervision orders (s.66) and attendance centre orders (s.67).

Part III concludes with a miscellaneous section.  The act states that persons aged 17 are to be treated as young persons for certain purposes (s.68).  Details are given for the non-appearance of persons aged 16 or 17 where the plea is guilty (s.69), the renaming of juvenile courts etc. (s.70).

Part IV give details of the provision of services, this includes duties of the inspectors of probation (s.73).

SCHEDULES

Schedule 1A sets out the additional requirements in probation orders, Sch. 1A(4) provides for the extension of requirements for sexual offenders.
Schedule 4 – Lists the increase of certain maxima.
Schedule 8 – Gives the amendments for treating persons aged 17 as young persons.
