THE CRIMINAL JUSTICE ACT 1948

Part 1 applies to the powers and proceedings of Courts.  Sections 16 – 20 apply to the powers relating to young offenders.  This includes a restriction on the sentence of death (s. 16), restriction on imprisonment (s. 17), detention in a detention centre (s. 18), attendance at an attendance centre (s. 19) and provisions regarding borstal training (s. 20).

Part II sets out provisions relating to the administrative provisions as to treatment of prisoners.  Section 48 applies to remand centres, detention centres and borstal institutions.  Section 49 applies to remand homes.

Part III contains supplemental provisions.  Section 75 sets out the power to order detention in a remand centre under s.67 of the Children and Young Persons Act 1933.
