THE CHILDREN AND YOUNG PERSON ACT 1969
Part I relates to the care and other treatment of juveniles through court proceedings.
Care of children and young persons through juvenile courts are set out under Sections 1 – 3. Consequential changes in criminal proceedings are explained in Sections 4 – 10. Section 24 expressly gives the powers and duties local authorities with respect to persons committed to their care. Further areas are addressed directly. This includes supervision (s.11 – 19), children and young persons committed to care of local authorities (s.20 – 24), transfer of children between England, Wales and Northern Ireland and the Channel Islands or Isle of Man (s.25 – 26), detention (s.28 – 32) and legal aid (s. 33).
Part II specifically focuses on the accommodation for children in care and foster children.
Community homes are dealt with in Sections 35 – 48. Areas include: regional planning of accommodation for children in care (s.35), regional plans for community homes (s.36), approval and variation of regional plans (s.37), provision of homes by local authorities (s.38), instruments of management (s.39), management of controlled and assisted community homes (s.41-44), determination of disputes in regards to controlled as assisted community homes (s.45), discontinuance of approved schools on establishment of community homes (s.46), discontinuance by voluntary organisation of controlled or assisted voluntary homes (s. 47) and financial provisions (s.48).
Sections 49 – 50 deal with consequential modifications of ss. 13 and 19 of Children Act 1948. Section 49 applies to provision of accommodation and maintenance for children in care. Section 50 applies to accommodation of persons over school age in convenient community home.
Foster children are considered under Sections 51 – 57 of the Act. Section 51 sets out the modification of general duty of local authorities with respect to foster children. Section 52 lays down the amendments of definitions of foster child and protected child. Section 53 sets out the modifications of duty of persons maintaining foster children to notify the local authority. Inspections of property and requirements are set out in Sections 54 – 55. Extension of disqualification for keeping foster children and modifications of provisions as to offences are set out under Sections 56 – 57.
Inspections of children’s homes etc are covered under Section 58. Section 59 sets out the powers of entry supplemental to s.58.
Part III incorporates the miscellaneous and general provisions.
Sections 60 – 63 include details on extradition offences, the rules relating to juvenile courts, contributions in respect of children and young persons in care and return of information and reports.
Sections 64 – 67 set out financial provisions. Including expenses of Secretary of State, grants to voluntary organisations, increase of rate support grants and administrative expenses.
Sections 68 – 73 are supplemental. Section 69 includes details on orders and regulations. Section 70 gives details on interpretation and ancillary provisions.
