Education Act 2005

The idea behind the 2005 was to simplify the school improvement process, improve data flows and strengthen the accountability framework for schools. The intention of the Act is also to introduce shorter, more regular and less burdensome inspections.

Part 1 of the Act repeals the School Inspection and introduces a new system of more regular, “lighter touch” inspection. HM Chief Inspector of Schools has  powers of entry and a duty to inspect certain at prescribed intervals. There are also duties to notify parents of the section 5 inspection and a duty to have regard to views of certain persons, i.e the head teacher, the governing body or proprietor, staff, pupils and parents.

Part 2 extends the circumstances in which a local education authority must invite proposals for a new or replacement secondary school.

Part 3 relates to the Teacher Training Agency.

Part 4 contains a number of miscellaneous provisions relating to maintained schools, information sharing and attendance for excluded pupils at alternative educational provision.

Part 5 contains general incidental and supplemental provisions.
