The Children’s Homes Regulations 1991

Part I contains introductory provisions.  Regulation 3 sets out the application of the regulations to different classes of children’s homes.

Part II applies to the conduct of Children’s Homes (Regulation 4 –14).  Provisions include a statement of purpose and function of children’s homes (Regulation 4), staffing of children’s homes (Regulation5), accommodation for individual children (Regulation 6), accommodation: general provisions (Regulation 7), control and discipline (Regulation 8), storage of medicinal products (Regulation 9), employment and education of older children (Regulation 10), religious observance (Regulation 11), food provided for children and cooking facilities (Regulation 12), purchase of clothes (Regulation 13) and fire precautions (Regulation 14).

Part III sets out provisions regarding the administration of Children’s Homes.  Regulation 15 requires records to be maintained in relation to an individual child.  Regulation 16 sets out the access by guardians ad litem to records and register.  Regulation 17 addresses other records with respect to children in children’s home.  Regulation 19 requires notification of significant events.  Other provisions include the absence of a child without authority (Regulation 20), absence of the person in charge (Regulation 21) and the accountability and visiting on behalf of the responsible authority (Regulation 22).

Part IV contains provisions that apply to Community Homes.  This includes the Secretary of State’s directions (Regulation 23).  Part V addresses the registration of voluntary homes.  Regulation 24 sets out the application for registration of a voluntary home.  Part VI applies to the registration of registered Children’s Homes.  Provisions include the application for registration of registered children’s home (Regulation 25), limit on number of children accommodated (Regulation 26), annual review of registration (Regulation 27), inspection of registered children’s homes (Regulation 28), cancellation of registration (Regulation 29) and details of a change of person in charge (Regulation 30).

Part VII addresses the notification of Particulars with respect to Voluntary Homes.  Regulation 31 sets out the particulars on establishment of a voluntary home.  Part VIII contains provisions that apply to local authority visits.  Regulation 32 provides for the circumstances necessitating a visit by the Local Authority.  Regulation 33 provides for further visits and Regulation 34 states the requirements for visits.

Part IX contains general provisions.  Regulation 35 sets out the revocation of regulations.
