Section 1 – 12 lists the offences against children. Procedural details are explained in Sections 13 – 17 in respect of taking offenders into custody, charges and identifying who is responsible for the child.
Part II gives details for children within the employment field. Entertainment and performances and employment abroad have specific restrictions. Sections 18- 24 sets out general details as to working hours, holidays and working during school term time. Section 19 relates to bye laws relating to employment of persons under the age of 18 other than children. Street trading is prohibited and explained under Section 20. The Act sets out when children can participate in performances and limits the number of performances. Sections 22 – 24 gives details in regard to training and prohibits acts of a dangerous nature unless a licence has been granted. Section 25 restricts employment abroad, licences can be granted. Section 26 gives details of punishments to those who are found guilty in relation to employment abroad. Section 27 states that bye laws do not have an effect unless confirmed by Secretary of State. Section 30 gives details on the interpretation of Part II.
Part III gives details regarding the protection of children and young persons in criminal and summary proceedings. Section 31 gives details on detention of children in criminal matters. Section 32 lists exceptions when a person under the age of 17 cannot be released on bail and details of detention. Section 34 gives details of the attendance of parents in court. Section 35 gives details on notifying the local authorities. Section 37 to Section 39 lists further procedural requirements. Section 37 and 38 discuss procedures when children give evidence. Section 39 grants the court power to prohibit publication.
Section 40 gives details on issuing a warrant to search for and remove a child or young person this includes those acting in the interest of the young person. Section 41 gives power to proceed with the case in the absence of a child or young person. Section 42 gives a power to take in writing the deposition of a child or young person.
Sections 45 – 49 state the procedures in relation to juvenile courts. Juvenile offenders are addressed under Sections 50 – 60. Section 53 addresses serious crimes. Section 54 discusses substitution of custody in a remand home. Section 55 deals with parents paying fines. Section 56 grants a power of other courts to remit juvenile offenders to juvenile courts. Section 57 allows children found guilty to be sent to approved schools or to commit them to fit persons.
Section 61 defines ‘children in need of care or protection.’ Section 62 grants the juvenile court power and lists what to do in respect of children in need of care or protection. Section 63 grants powers to other courts when dealing with juveniles in need of care or protection. Section 64 addresses the power of parent or guardian to bring a child or young person before juvenile court. Section 65 relates to power of poor law authority. Section 66 relates to supervision by probation officers.
Section 66 – 76 gives further details to take into consideration in regard to detaining, removing, children and placing in care and schools. Regard to religion when making an approved school order is addressed under Section 68. Section 69 deals with coming into force of approved school orders. Section 70 states content of approved school orders and Section 71 sets out duration. Section 72 deals with conveyance of children or young persons to approved school. Section 73 – 75 discusses extension for detention, recall after expiration, provisions to make during the order and effects of orders of committal to fit persons and Local Authority.
Details of remand homes are dealt with under Section 77-78, approved schools under Sections 79-83. Section 84 looks committing a child or young person to care of fit persons. Section 86 – 91 considers contributions towards expenses. Section 87 sets out enforcement of duty of parent to make contributions. Section 90 gives details of contributions by local authorities in respect of persons sent to approved schools. Voluntary homes are defined under Section 92 and further requirements set out under Sections 93-95.
Sections 96 – 98 States provisions of Local Authorities, the powers and duties in regard to education and to institute proceedings by local or poor law authorities. Section 99 – 102 give details of legal proceedings in relation to evidence, such as determining age, wages, application of summary Jurisdiction acts and appeals. Sections 105 – 109 gives general provisions as to documents and interpretations.
SCHEDULES
FIRST SCHEDULE: Offences against children and young persons in which special provisions apply. Offences cover murder and manslaughter, infanticide, specific offences under the Offences Against a Person Act 1861, offences under Punishment of Incest Act 1908 or other offence involving bodily injury to a child or young person.
SECOND SCHEDULE: Relates to the constitution of Juvenile Courts outside Metropolitan areas, within the Metropolitan Police Court Area and in the City of London.
THIRD SCHEDULE: States the amendments of certain enactments relating to criminal proceedings and Courts of Summary jurisdiction.
FOURTH SCHEDULE: Gives provisions as to administration of approved schools and treatment of persons sent. This schedule includes misconduct of pupils, details on discharge and transfer and powers and duties of Managers and other Persons in Charge of Pupils.
FIFTH SCHEDULE: Transitory provisions.
