These terms and conditions contain important information as to your rights and obligations for use of http://www.mjsol.co.uk (“the Website”).

These terms and conditions are valid between Malcolm Johnson & Co Solicitors (“Mjsol”) and yourself as a user of this website (“the User”).

By using the Website you agree to be bound by the following terms. If you do not agree to the following then no permission is granted for the use of the Website.

About

The Website is supplied free of charge for the purpose of providing online information about Mjsol and personal injury law within the UK to current and prospective clients as well as personal injury law students and practitioners.

Access Provisions

The Website and its contents may be altered, removed or replaced by Mjsol at any time without notification. No warranty is given as to the accessibility of the Website at any time.

The Website is provided for explanatory purposes only and is neither meant as, should be read as or should take the place of, legal advice of any kind.

The Website may contain material unsuitable to those under the age of 18 and thus no access rights are granted to anyone under such age.

Data

Any information entered into any contact form on the Website shall be deemed confidential and shall be treated as such in accordance with Mjsol’s standard policy on confidential information at that time. Data from such forms may be stored for the following purposes:

  • managing the User’s claim; and
  • providing further services to the User; and
  • as required by any law or request of any court of competent authority.

Mjsol will not be in breach of any obligation to keep any confidential information confidential or not to disclose it to any other party to the extent that it:

  1. is known to Mjsol before its receipt from the User, and not already subject to any obligation of confidentiality to the User;
  2. is or becomes publicly known without any breach of this agreement or any other undertaking to keep it confidential;
  3. has been obtained by Mjsol from a third party in circumstances where Mjsol has no reason to believe that there has been a breach of an obligation of confidentiality owed to the User;
  4. is disclosed pursuant to the requirement of any law or regulation or the order of any court of competent jurisdiction; or
  5. is approved for release in writing by the User.

For the sake of clarity no information entered in to any comments form on the Website shall ever be treated as confidential information.

The website uses third-party statistics and traffic analysis packages (“Statistics Software”).  The third-parties providing Statistics Software are currently:

  • Google Inc
  • Thermal Degree Ltd

Such third-parties are liable to change without notice; however data shall not be transferred between third-parties except where third-parties are affiliates of each other.

The information generated by the Statistics Software about the User’s use of the Website (including their IP address) will be transmitted to and stored by said third-parties on servers in the United States and the United Kingdom. Such information shall be used by the third parties for the purpose of evaluating the User’s use of the Website, compiling reports on website activity and providing other services relating to website activity and internet usage.

Information may be provided to further third parties where required to do so by law, or where such third parties process the information on Mjsol’s behalf. By using this website, the User consents to the processing of data through the Statistics Software in the manner and for the purposes set out above.

Security

Mjsol provides no warranty that the contents of the Website are free from viruses, trojans, spyware or any other form of malware. It is the User’s responsibility to install and keep updated appropriate malware protection.

Intellectual Property

Except where expressly stated the Website and all its contents (including but not limited to text, images, source-code, domain and all copyright, patents, designs, know how and trademarks therein) are owned by or otherwise licensed to Mjsol.

The User grants Mjsol a non-exclusive, worldwide, irrevocable, royalty-free license to copy, adapt, publish, reproduce, backup, distribute or otherwise use any information entered into any comments box on the Website. Such license shall include the right to sub-license. Such license shall impose no obligation upon Mjsol to publish said comment.

Mjsol grants no license to reproduce, distribute, modify or otherwise make use of any intellectual property contained within the Website except where necessary in the opinion of Mjsol for use of the Website in accordance with these terms and conditions.

Subject to the above Mjsol shall have no liability towards the User for any breach of this agreement, the content of the website (including but not limited to its accuracy and completeness), any negligence or arising in any other way out of the Website including but not limited to direct and indirect damages, losses, or any delay, damage to reputation, hardware or software, goodwill, loss of business, anticipated profits, data, loss of disputes, contracts or opportunity whether direct or indirect, even if the User has advised Mjsol of the possibility of those losses, or if they were within Mjsol’s contemplation.

The express undertakings and warranties in this agreement are in lieu of all other warranties, conditions, terms, undertakings and obligations, whether express or implied by statute, common law, custom, trade usage, course of dealing or in any other way.  All of these are excluded to the fullest extent permitted by law.
