New cases on limitation and duty of care in child abuse compensation claims
Today we report on two new cases, both from the High Court.
In AB and Others v Nugent Care 2010 three Claimants suing the Defendant for abuse suffered as children in care had to get over the limitation hurdle. Two succeeded but one did not.
In Merthyr Tydfil County Borough v C 2010 a mother who told a local authority that her children were being abused was told to keep them indoors. Later she reported that they had been abused again, but the local authority denied that they had ever received the first report. The Defendant tried to strike out her case, but the court let her case proceed.
