Teacher charged with sexually assaulting a child
11th June 2009
BBC News reports how a teacher from Greater Manchester has been charged with the sexual assault of a 13 year old.
Sexual assault on pupils by a teacher can give rise to liability for the employer. In a state school, this would be the local education authority. In the case of X & Y versus London Borough Of Wandsworth [2006] EWCA Civ 395 the Court of Appeal found that the Defendant authority was vicariously liable for sexual assaults carried out on two children by a teacher.
In the subsequent appeal to the House of Lords, (A v Hoare [2008] UKHL 6 (30 January 2008)), the Lords awarded the Claimants damages in the sum of £57,500 and £70,000 respectively.
