Teacher sexually assaulted by boy sues school
23rd June 2009
A teacher raped by a pupil at a London school had successfully recovered damages against the school. The assault occurred in September 2004. She argued that her assailant should have been excluded for a previous sexual assault, where he was the main suspect. He also had a record of belligerence and violence. The school continues to deny liability.
Schools owe duties of care not only to pupils but also to teachers, who are employed by them. This case appears to have been based on the premise that the school should have foreseen that an assault might take place.
