A Darlington family adopted a child who has become uncontrollable. The problem has become so bad that the child has now been put into care. Apparently the family want to send the child on a six month course of psychotherapy at a specialist treatment centre for children with Reactive Attachment Disorder.
In A & Anor and Essex County Council [2003] EWCA Civ 1848 A and B were a couple who adopted two young children recommended by Essex County Council. Following the adoption, the boy became impossible to control to the extent that he damaged A and B’s home and family life. He was eventually diagnosed with Attention Deficit Hyperactivity Disorder and was medicated by Ritalin. The High Court found that Essex had been negligent for failing to provide A and B with all the relevant information about the two children whom they were going to adopt. The Court of Appeal held that once a local authority or agency has decided what information should be given to prospective adopters, then there was a duty to take reasonable care to ensure that that information is both given and received.
