Criminal Injuries Compensation Authority denies compensation to victims abused before 1st October 1979

Crawley News reports how a woman abused by her stepfather has been denied compensation, because the abuse was committed by a member of her own family living in the same household before 1979. The abuse occurred between 1966 and 1977.

The pre 1979 rule contained in the Criminal Injuries Compensation Scheme has long been criticized as unfair. The rule has been unsuccessfully challenged in RP and TG v Secretary of State for the Home Department and CICB (unreported), 4th May 1994 and Stewart v UK (unreported 6th July 1999) as well as two Scottish cases, S v Advocate General for Scotland (unreported 5th December 2002) and S v CICB and the Advocate General (unreported 8th July 2004).
