Court of Appeal rules on limitation cases

The Court of Appeal have handed down a judgment in relation to four cases of child abuse in AB AND OTHERS VERSUS NUGENT CARE SOCIETY: GR V WIRRAL METROPOLITAN BOROUGH COUNCIL [2009] EWCA Civ 827.

AB concerned three cases of historic child abuse in St Aidan’s children’s home whilst in the case of GR, the Claimant had been abused by an escort officer in a children’s home.
All the cases had been stayed awaiting the appeals in A v Hoare and Others [2008] 2 WLR 311. The issues to be decided related to limitation.
Two of the Claimants in AB succeeded in their appeals, but a third lost his appeal. GR won his appeal. The judgment of Lord Clark in the Court of Appeal provides valuable guidance in this difficult area of the law.
